These Terms govern your use of the website mbvyn.com (the "Site") operated by Mykola-Bohdan Vynnytskyi, a private entrepreneur registered in Ukraine, operating under the brand MBVYN. By accessing the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Nature of the Site
The Site is an informational portal. It introduces Mykola-Bohdan Vynnytskyi's work as a data-driven mentor and architect, lists products, mentorship programs, and consulting formats, and provides ways to get in touch.
The Site itself does not sell anything, does not process payments, and does not create user accounts. Engaging in mentorship, consulting, or any paid service is governed by a separate agreement negotiated and confirmed for each engagement, in writing or by email.
2. Use of the Site
You agree to use the Site lawfully and in good faith. You will not:
- attempt to gain unauthorized access to the Site or its hosting infrastructure;
- scrape, mass-download, or republish Site content without permission;
- submit false, misleading, or unlawful information through any form on the Site;
- use the Site to transmit malware, spam, or any harmful code.
3. Intellectual property
All text, graphics, layout, icons, and code on the Site are owned by Mykola-Bohdan Vynnytskyi or used with permission, and are protected by copyright and other intellectual-property laws. You may view and share links to Site content for personal, non-commercial purposes. Any other use — including reproduction, redistribution, or derivative works — requires prior written consent.
Third-party trademarks, logos, and product names referenced on the Site (e.g. Medium, YouTube, Udemy, Databricks, Snowflake, Microsoft) belong to their respective owners and are used for identification purposes only.
4. External links and third-party services
The Site links to and embeds third-party services, including Kit (newsletter subscription) and Cal.com (meeting scheduling), and references external resources on Medium, YouTube, Udemy, GitHub, LinkedIn, X, and others. We are not responsible for the content, availability, or practices of these third parties. Your use of their services is subject to their own terms and privacy policies.
5. Affiliate disclosure
Some external links on the Site — for example, course recommendations on the Insights page — are affiliate or referral links. If you click such a link and complete a purchase or sign-up, we may receive a small commission from the third-party platform at no additional cost to you. This does not influence which courses or resources we recommend; we only point to materials we have personally used or reviewed.
6. Forms and submissions
When you subscribe to product notifications or book a meeting, your information is processed as described in our Privacy Policy. You are responsible for providing accurate contact details. Subscribing does not, by itself, create any contractual obligation beyond receiving the relevant notifications, which you can cancel at any time.
7. Disclaimers
Content on the Site (articles, videos, course recommendations, opinions, technical advice) is provided for informational and educational purposes only. It is not professional advice tailored to your specific situation, and it does not create a mentor-mentee, consultant-client, or any other professional relationship until a separate agreement is in place.
The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.
8. Limitation of liability
To the maximum extent permitted by applicable law, Mykola-Bohdan Vynnytskyi shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from your use of, or inability to use, the Site or any third-party service linked from it.
Liability for paid services (mentorship, consulting, products) is governed by the separate agreement covering those services.
9. Changes to the Site and to these Terms
We may modify, suspend, or discontinue any part of the Site at any time. We may also revise these Terms; the "Effective date" at the top will reflect the latest revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
10. Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought before the competent courts of Ukraine, except where mandatory consumer-protection laws of your country of residence provide otherwise.
